Terms of use

These Terms of Use govern your use of the GeneaGenie website, accessible at https://www.geneagenie.be, and its related services (the "Service"), provided by CodeControl BV, with its registered office at Menenstraat 343, 8980 Geluveld, Belgium.
1. Acceptance of terms
By registering for GeneaGenie, accessing, or using the Service, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service.
2. Description of the service
GeneaGenie is a genealogy search engine that allows users to upload a GEDCOM file (the "User File") to perform automated searches in publicly accessible historical archives and genealogy websites.
3. User account and payment
3.1 Registration: To use the Service, you must create an account by providing an email address, your first name, and last name. You are responsible for maintaining the confidentiality of your password.
3.2 Credits: Access to the Service operates on a credit system. The purchase of credits is a one-time payment. Credits are non-refundable.
3.3 Credits: One credit equals the search of one individual in your User File. Credits do not expire.
4. User obligations and content (GEDCOM file)
4.1 Content license: You retain all ownership rights to your User File. By uploading a User File, you grant GeneaGenie a limited, non-exclusive, and temporary license to use, process, and store the User File solely for the purpose of conducting the genealogical search requested by you.
4.2 File deletion: Your User File is stored temporarily during the search process and is securely deleted from our servers once the search is completed. Only the search results are stored in your private account.
4.3 Accuracy and legality: You warrant that the User File you upload:
- Does not contain any unlawful or offensive data.
- Complies with copyright laws (GEDCOM content is generally considered unprotected historical facts, but it is your responsibility to ensure the legality of its content).
- Is uploaded legitimately.
4.4 Privacy compliance: You are responsible for ensuring that the processing of data of living persons contained within your User File complies with applicable data protection laws.
5. Intellectual property
5.1 GeneaGenie ownership: The website, search technology, algorithms (including machine learning algorithms), and content of the Service (excluding User Files) are owned by CodeControl BV and are protected by copyright and intellectual property laws.
5.2 User ownership: You own the data within your User File and the genealogical matches found and stored in your private account.
6. Disclaimer and limitation of liability
The Service is provided on an "as is" basis. CodeControl BV does not warrant that the Service will be uninterrupted, error-free, or that the search results will be exhaustive or accurate. To the fullest extent permitted by law, CodeControl BV shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service.
7. Termination
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if you breach these Terms of Use. In the event of termination, unused credits will not be refunded.
8. Governing law and jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws of Belgium. Any dispute arising out of the use of the Service shall be submitted to the exclusive jurisdiction of the courts of Kortrijk, Belgium.
